Patent lawsuit over cube camera

Meanwhile, there is now a legal issue between Polaroid and GoPro for the latter’s recent release of a cube camera. Just like the Polaroid Cube, GoPro Hero 4 Session came out in July as a cube camera.

According to the lawsuit, the design of the GoPro Hero 4 Session infringes on the design patent that was exclusively granted to Polaroid Cube by the US patent office in May 2014.

The two cameras are both cubes so the lawsuit appears to favor the plaintiff. However, the actual patent is quite vague because it only covers the ornamental design for a cubic action camera, which was shown in the patent application for a cube camera using seven illustrations, details The Verge.

The Polaroid Cube is more than a year and a half in the market already while the GoPro Hero 4 Session was only released in July this year.

However, Polaroid is not actually the one which filed the lawsuit against GoPro because it just put its name on the cube camera and did not actually manufacture it. It is actually C&A Marketing, which owns the design and patent behind the cube camera, that is suing GoPro,

The company has also petitioned to the court to stop the sales of the GoPro Hero 4 Session and also sought monetary damages including all of GoPro’s profit from the sale of its cube-shaped action camera.
